Challenging Civil Rights Rollbacks at EEOC (Cross v. EEOC)
Under the Trump Administration, the Equal Employment Opportunity Commission (EEOC) has betrayed workers by stopping investigations into disparate-impact discrimination charges, illegally abandoning decades of civil rights precedent. Disparate impact refers to a policy that is not justified by business needs that has an unequal impact on people of different races, genders, sexual orientations, ages, or other protected status.
When Plaintiff Leah Cross worked as a delivery driver for Amazon, the company denied her and other drivers bathroom breaks, which she alleges had a disparate impact on drivers with anatomy typical of people assigned female at birth. The EEOC began investigating Cross’s charge, but then abruptly ended the investigation as a result of Trump’s executive order.
