The agribusinesses argued that the provisions violated their right to exclude individuals from their land. In a victory for the state\u2019s agricultural workers, the agribusinesses <a title=\"https:\/\/usw2.nyl.as\/t1\/238\/56vdyrq7nbh75ffl5k80j4ul\/3\/3001f4326095db499e1a8ddac96e0e40e35be81c0333e94593399c10ef5dc756\" href=\"https:\/\/usw2.nyl.as\/t1\/238\/56vdyrq7nbh75ffl5k80j4ul\/3\/3001f4326095db499e1a8ddac96e0e40e35be81c0333e94593399c10ef5dc756\" target=\"_blank\" rel=\"noopener\">dismissed their case<\/a> three months later, ensuring service providers could continue their critical work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now the&nbsp;<span class=\"gmail-il\">Colorado<\/span>&nbsp;Livestock Association filed a near-identical suit in&nbsp;<span class=\"gmail-il\">Colorado<\/span>&nbsp;District Court under the takings clauses of the U.S. Constitution and&nbsp;<span class=\"gmail-il\">Colorado<\/span> Constitution, challenging the provision that prohibits agricultural employers from \u201cinterfer[ing]\u201d with their workers\u2019 \u201creasonable access to key service providers at any location during any time in which the agricultural worker is not performing compensable work or during paid or unpaid rest and meal breaks,\u201d as well as any time the worker is receiving healthcare services. Today\u2019s motion to intervene seeks to defend this important provision that ensures agricultural workers\u2019 access to fundamental services like healthcare, education, and legal help.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cToday\u2019s intervention underscores the ongoing importance of protecting farmworkers\u2019 access to vital services, which is clearly protected under the law,\u201d <strong>said Jenifer Rodriguez, managing attorney of the&nbsp;<span class=\"gmail-il\">Colorado<\/span>&nbsp;Legal Services Migrant Farm Worker Division<\/strong>. \u201cJust like last year\u2019s challenge, this is&nbsp; a baseless attempt to undermine important laws that safeguard workers\u2019 rights. And just like last year, we believe this lawsuit will be dismissed.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAgricultural workers are some of the most vulnerable, exploited, and isolated in <span class=\"gmail-il\">Colorado<\/span>, working long hours, exposed to the elements, and often dependent on their employers for housing and transportation,\u201d said <strong>Kelsey Eberly of FarmSTAND<\/strong>. \u201cYet agribusinesses have sought to strip workers of even the minimal protections the new law provides\u2014of their ability to see a community health worker or attorney\u2014in effect claiming a constitutional right to interfere with their workers\u2019 access to these vital services. We\u2019re stepping in again to defend <span class=\"gmail-il\">Colorado<\/span> agricultural workers\u2019 hard-won rights.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span class=\"gmail-il\">Colorado<\/span> Legal Services is represented by FarmSTAND, Towards Justice, and Farmworker Justice.
