{"id":731,"date":"2022-11-07T19:55:25","date_gmt":"2022-11-07T19:55:25","guid":{"rendered":"https:\/\/farmstand.chee.studio\/colorado-worker-group-intervenes-to-oppose-constitutional-challenge-to-states-workers-rights-statute\/"},"modified":"2026-09-11T22:25:26","modified_gmt":"2026-09-11T22:25:26","slug":"colorado-worker-group-intervenes-to-oppose-constitutional-challenge-to-states-workers-rights-statute","status":"publish","type":"post","link":"http:\/\/farmstand.org\/es\/colorado-worker-group-intervenes-to-oppose-constitutional-challenge-to-states-workers-rights-statute\/","title":{"rendered":"Colorado Worker Group Intervenes to Oppose Constitutional Challenge to State\u2019s Workers\u2019 Rights Statute"},"content":{"rendered":"\n<p class=\"has-text-align-center wp-block-paragraph\"><strong>Colorado Worker Group Intervenes to Oppose Constitutional Challenge to State\u2019s Workers\u2019 Rights Statute <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Monday, November 7, Colorado Legal Services and an anonymous farmworker <a href=\"http:\/\/farmstand.org\/wp-content\/uploads\/2022\/11\/2022.11.04-Dkt-38-Unoppd-Mot-to-Intervene-as-Def-with-declarations.pdf\">filed a motion to intervene<\/a> in order to defend the constitutionality of a Colorado statute that provides access to vital protections and services for farmworkers, particularly those who live and work in rural communities. Colorado Legal Services is represented by Public Justice, Towards Justice, and Farmworker Justice.&nbsp; The individual farmworker is represented by the Migrant Farm Worker Division of Colorado Legal Services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2021, Colorado enacted a farmworker rights bill which, among other things, prohibits farmers and ranchers from \u201cinterfer[ing] with an agricultural worker\u2019s reasonable access to key service providers [&#8230;] defined to include health care workers, education providers, attorneys, government officials, and clergy, among others.\u201d Citing the U.S. Supreme Court\u2019s ruling in <em>Cedar Point Nursery v. Hassid<\/em>, several agricultural employers filed a lawsuit challenging the key service provider access provisions, arguing that protecting workers\u2019 access to health care, legal services and other essential services violates the right property owners have to exclude individuals from their land. Colorado Legal Services and the individual farmworker seek to defend the constitutionality of the key service provider access provision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Colorado Legal Services\u2019 Migrant Farm Worker Division provides comprehensive legal services to farmworkers on a variety of legal issues including wage theft, workplace safety, civil rights (including human trafficking and sexual harassment) and immigration. As part of their work, they meet with thousands of workers each year, including those who live in employer owned or operated labor camps, which are often located on employer property. Since the lawsuit, CLS staff has been harassed while meeting with farmworkers, including being physically threatened with a pistol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFor the protection of the legal rights of agricultural workers, who are frequently isolated, speak little or no English and have limited ability to obtain the services they need, it is essential for CLS to have access to the workers,\u201d said <strong>Colorado Legal Services Executive Director Jonathan D. Asher<\/strong>. \u201cTo deny necessary access is to deny agricultural workers their basic rights, legal information and the legal representation they frequently desperately need.&nbsp; The statute must be defended to protect the rights of the agricultural workers.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBecause many farmworkers come from immigrant backgrounds, may be undocumented, and encounter language barriers, they are especially vulnerable to abuse by industrial agriculture operations and often face hazardous workplace conditions,\u201d said <strong>Public Justice Food Project Litigation Director David Muraskin<\/strong>. \u201cColorado\u2019s 2021 statute ensures safe workplaces for agricultural workers by safeguarding their access to key service providers, and challenging this important law puts farmworkers\u2019 lives in danger.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAgricultural workers face unusual challenges in accessing critical health care and social services because it is nearly impossible to visit doctors, banks, and other key service providers when they are working during the hours those services are typically available,\u201d said <strong>Towards Justice Attorney Valerie Collins.<\/strong> \u201cIt is imperative that agricultural workers have access to key services not only for the individual worker, but for their families and communities.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Colorado Worker Group Intervenes to Oppose Constitutional Challenge to State\u2019s Workers\u2019 Rights Statute On Monday, November 7, Colorado Legal Services [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"inline_featured_image":false,"footnotes":"","_links_to":"","_links_to_target":""},"categories":[37],"tags":[36,41],"issue":[17],"class_list":["post-731","post","type-post","status-publish","format-standard","hentry","category-press-releases","tag-public-health","tag-workers","issue-worker-justice"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.5 -
