Everyone should be able to work with dignity and access resources that better their working conditions and lives.<\/strong> However, agribusiness interests have threatened Colorado farmworkers\u2019 right to access essential services where they work.<\/p>\n\n\n\n

A<\/span>gricultural workers tend to be isolated<\/span> and work long hours<\/span>. Many live in employer-owned housing or migrant labor camps on or near the farm <\/span>or range <\/span>where they work, far from nearby towns or services.\u202f<\/span><\/span>This makes it difficult for farmworkers to access essential service providers like doctors, teachers, clergy members, <\/span>community aid workers<\/span>, and attorneys, creating obstacles to a basic quality of life.<\/span><\/span> <\/span><\/span> <\/span><\/p>\n\n\n\n

A 2021 Colorado farmworker rights bill ensures<\/span> that farmworkers can access these essential service providers<\/span> fre<\/span>e from interference by their employers<\/span>. But <\/span>agricultural <\/span>employers <\/span>and agribusiness interests have <\/span>archivado <\/span>two <\/span>demanda<\/span>s<\/span> seek<\/span>ing <\/span>to invalidate <\/span>that right, arguing that workers\u2019 access to essential services violates employers\u2019 property rights.\u202f<\/span><\/span>FarmSTAND<\/span>, Towards Justice, and Farmworker Justice <\/span>represented <\/span>Colorado Legal Services<\/span> in <\/span>interven<\/span><\/span>in<\/span><\/span><\/span>g<\/span><\/span><\/span> in the <\/span>suit<\/span>s<\/span>,<\/span> to defend the constitutionality <\/span>and enforceability <\/span>of the <\/span>challenged <\/span>provisions<\/span>.<\/span><\/span><\/span><\/a>\u202fColorado Legal Services Migrant Farm Worker Division <\/span>also <\/span>represent<\/span>s<\/span> an anonymous, individual farmworker in the same legal action<\/span>s<\/span>.<\/span><\/span> <\/span><\/span><\/span> <\/span><\/p>\n\n\n\n

After our intervention<\/span> in the first case<\/span>, <\/span><\/span>t<\/span>he agribusinesses dismissed their lawsuit<\/span><\/span><\/span><\/a>.<\/span> But a Colorado livestock industry group soon<\/span> after<\/span> filed a<\/span> new <\/span>legal <\/span>challenge<\/span><\/a> mirroring the first<\/span>, <\/span>prompting<\/span> the coalition\u2019s <\/span>rene<\/span>w<\/span>ed<\/span> effort<\/span> to defend the law\u2019s vital protections.<\/span><\/span> <\/span><\/p>\n\n\n\n

Without the provisions in the farmworker bill of rights, farmworkers were\u2014and would be\u2014denied access to basic services. For example, the anonymous farmworker missed school programs, meetings with teachers, and visits to the doctor because she could neither leave work on her break nor invite her doctor or her child\u2019s teachers to visit her where she lives.\u202f<\/span>Colorado Legal Services, which provides legal services to agricultural workers<\/span><\/a>\u202fon issues including wage theft, workplace safety, human trafficking, sexual harassment, and immigration, has historically faced challenges, and even threats of violence, when accessing or attempting to reach migrant workers at labor camps.<\/span> <\/span><\/p>\n\n\n\n

On May 10, 2024, Judge Martin F. Egelhoff’s ruling<\/a> dismissed the second legal challenge on the basis that members of the Colorado Livestock Association did not have standing to bring the suit. On June 26, 2024, the Colorado Livestock Association appealed the ruling. <\/span><\/span><\/strong><\/p>\n\n\n\n
